Just heard that the Hearing this morning is going ahead, court has not been affected by the strike at all, hopefully will be able to either update later this afternoon or tomorrow morning, |

Trial date to be set on the 17th they have to appear at Burnley to hear when and where they stand trial ...........today was a final hearing to see if any further charges where to be be made, but no further charges other than those they were charged with last week were made...............so they have been jointly charged with 21 counts of cruelty and neglect with further offences to be taken into consideration |

Yes Barbara it is utterly astonishing how plausible these sick people were, judging by their posts they were the epitome of loving and knowledgeable horse owners, always posting positive stories and pictures whilst completely neglecting the poor animals who depended on them. Completely outrageous - lets hope it's a long sentence. |

Whilst I totally appreciate your sentiments, please do not prejudice this case before it is heard - innocent until proven guilty. It would be a tragedy if this case didn't get a full hearing due to a technicality. This is a public forum. |

Any information I have posted is freely available upon request from the relevant court office......if the information wasn't and I had posted 'privileged' information then I technically would be guilty of 'contempt of court'.........something in my job I dare not risk! |

Indeed Catherine. Facts that have been stated in open court or that are freely available in the public domain are OK. Personal comments, or opinion, or supposition, or wishing ill on anyone is not. Not till it's over, anyway. It's why when you read newspaper reports of trials they are very careful what they write, lots of speech marks to show quotes from the courtroom, and lots of allegedlies.
Be very careful, people. You risk prejudicing the trial or finding yourselves in contempt of court. |

Am still awaiting an update from the court as to what happened this afternoon, will be able to get more info in the morning and will post as soon as possible afterwards, lets hope this time you all have the outcome you want ie the trial date |

have news but not what you wanted.....the case has been adjourned (again) to 8th August at Blackburn, this is purely because they ran out of time yesterday as the Judge hearing the matter was delayed by another case that took quite a complicated turn. The suggestion put forward yesterday was to have the hearing in the presence of the Magistrates, which was objected to by the authorities so that is the reason for the delay. |

Is that because judges can give harsher sentences, Catherine? Now we all wait for the 8th August.

The District Judge can indeed hand out a harsher sentence, he can (if so inclined) send them to prison for 12 months for each offence they are found guilty of, whereas a Magistrate can only hand out a maximum sentence of 6 months. However if a DJ thinks that the offence warrants it he can send them to the Crown Court for sentencing |

Well said Bridie. My heart is with those waiting for news and the animals involved. It would be a tragedy if justice was impeded because of a forum discussion no matter how well meant or heartfelt.

Thank you, Catherine; I thought that was the case. Eventually we will find out what happened to our beloved horses and many thanks to you all for your expressions of sympathy as we all wait.
In the meantime we can look forward to the AHS summer show. I wasn't able to make it last year but will be going on Saturday this year. A time to be happy, catch up with friends from afar and see some lovely horses. Oh, nearly forgot; spend some money on our horses (and hopefully not buy even more Arab books)!!!!

A colleague of mine who works on the local paper up there has sent me this. He says he thinks it could drag on a bit!: A 55 year old Slaidburn woman has entered not guilty pleas to 20 charges relating to animal welfare. The charges involve, horses, dogs, cattle and sheep kept at Brookhouse Green Farm, Dale Head, Slaidburn and a field of Knotts Lane, Tosside. Rachelle Peel, 55, of Brookhouse Green Farm pleaded not guilty to all charges. He husband, who was not in court faces the same charges. Psychiatric reports have been prepared on his suitability to plead and these will be considered by the RSPCA which has brought the prosecutions. The cases were adjourned until September 25 for a further case management hearing prior to a two week trial which is expected to be held next year. |

OMG, next year and "Not guilty"!!!!!!! Words fail me which is just as well as we have to keep quiet for fear of "prejudicing a fair trial".
