Rosyw. Sorry about you loss, and all the pain ,frustrationand feelingsofheplessness it has brought with it.
There are many people from all sorts of govt departments that can enter you house and property,for whatever reason. I'm sure that for none urgent reasons part of the protocol would be to advise the landowner or tenant. Obviously this was'nt done.
Unfortunately we are living in an increasingly repressive, police state where laws are continually being passed to "protect our rights"but end up being repressive. Common courtesy and common sence counts for very little this only leads to frustration, anger and helplessness and despair.
You could get the local media involved, that may count for something. Going the way of lawyers could be expensive. You maybe better of in the long run by writing a letter to the dept responsible raising your concerns about their lack of courtesy and consideration. You Won't be alone in that. Don't get too down about it.

Pauline, thanks, I intend to stick with it, they will NOT get away with it!

Toothless, the legal route will be expensive but what they don't know is that I work in the entertainment business and have all the right contacts in the media, BBC etc., so they need to watch their backs!

Just seen the solicitor, really nice guy, he says we have a strong case against those concerned, and better still is that he will do all the neccessary work up to the point of going to court (which he says just won't happen) for £500, no matter what his costs are over and above that, so battle begins!!

rosie this might be of interest. Some years ago the high voltage pylon about 50 yards from my stable and house went crazy in a high wind. Arcing, flashing, you name it - it was like armageddon. My mare freaked and somehow burst out of her stable. When she galloped over the piece of ground above our underground telephone cable she dropped as if shot - I thought she had had a heart attack but she had been electrocuted. Thankfully she got up and although severely traumatised was apparently otherwise ok. The electricity co.had not maintained the cables properly. all the telephone lines had shorted out etc.The current had travelled under the ground and she had metal shoes on. I went to a solicitor and eventually got "compensation", including vets bills - but only after threatening mega publicity - settled out of court. They will certainly prefer to do it this way but you will probably have to call their bluff and dont take the first offer. Wont bring her back I know. Any chance electricy could have been involved?

Glad you have found a helpful solicitor.

Interesting that, about balloons... cos when balloonists landed on Lady King's land she had the balloon impounded and goodness knows what else (mind you, fair enough, they might have been IRA people on a budget); but balloons CAN be steered (they all avoid her land now) and fields for landing can be chosen (to a certain degree, anyway).

Best of luck with your fight. It won't bring your mare back but it might mean that procedures are changed, and that might save another animal's life...

Moosie, no electricity involved as far as we know, something caused a 'mass panic' and the mare tripped/slipped at great speed, crashing onto her chest and then apparently flipped over. The men on the field were sub contractors for National Grid Gas (formerly Transco), they certaily don't want any bad press, but I had an email from the BHS today asking my permission to pass details on to Horse & Hound, which of course was given.

Grey Girl, as you say it won't bring my mare back, but if I can help stop this happening to anyone else then great.
By the way everyone, solicitor says that even if they have permission to be on your land, what this comes down to is 'duty of care', take note!

Hi Toothless, the horse is Shahin (Straight Egyptian), I have a mare by him, and the one I lost in this incident was his grand daughter (not out of my mare). He was bred by Hans Nagel in Germany, then went to Claestorp Arabians in Sweden and from there to Kuwait.

Only just read this. So sorry to hear of the tragic loss of your mare; the only consolation is that she would have died almost instantaneously and wouldn't have suffered.

I have a water main under my field and when a new house was being built in the road the only reason I knew when they were coming out to connect the new house to the water main was that the person who was having the house built rang and told me, the water board never bothered. When I rang and complained it turned out that they had already done a survey and thought it was "common land". I am not sure how many areas of common land have big double wooden gates and are fenced off with Keepsafe fencing, not many I would think. It is just a shame Farouk was not there at the time as he likes to play with you and would have leapt all over them; I think they would have left quicker than they arrived.

Love the photo of Shahin, could you e-mail it to me if you have the original (or point me in the direction of where it is) as I have three Shahin daughters bred by Penny. I have a couple of photos of him but that one is nicer.

Rosie, wishing you all the luck in the world, I hope that you manage to "throw the book" at these idiots. You are obviously going down the right route and getting very helpful advice. I know, it won't bring your gorgeous girl back, but hopefully it will make these idiots see sense and make them think twice next time they decide to enter a field of "livestock".

Madmare - re bringing horses down with wire for films - are you saying that this is still allowed?!?! I thought everything had to conform to "no animals were harmed in the making of this film/programme" these days??
