I've just read on another forum that Tim the arab has been found in Scotland. His owner still doesn't have him back with her as there is a lot of red tape to get through as usual. At least she knows of his whereabouts and can hopefully get him back home very soon.

Fantastic news to greet us this morning..Hopefully Tim will soon be back in his Owners stable and once again, they can rekindle their Friendship.
Well done all who have relentlessy searched and found Tim. What a huge relief to know his whereabouts and that he is safe.

I really hope they have found him, there is nothing on the missing horses website about him being located.

| Hello All, thanks for your kind words. I can confirm that Tim has been located in scotland after a text from somebody. The woman that had him on loan had admitted the theft & selling and received a CAUTION!!!!. BUT.... I am still without horse. It has been decided by the police that this is now a civil case and i have to get him back my self... So here we go again over yet another hurdle. will keep you all posted. At least he is alive and safe but unfortunatley not yet home. Thinking of you Tim (missing you like mad)XX |

That stinks!
So even though the police know he belongs to you, you can't have him back without taking the new owner to court? I always thought that if you bought a horse that turned out to be stolen it still remained the property of the original owner. The law is a joke! The people who unwittingly bought him, did they not check his freezemark and passport for proof of ownership? |

| No they didnt. They bought him from a horse sale (out of the ring) The ironic thing is that his passport has been altered so the person that has him thinks he is 11 when infact he is 19. They just put passport in a draw!!! The law is pants. The woman who caused me all this stress and heart ache has been allowed to take my horse, sell him and keep the money she made from him.... Is there any justice in this world. I think not |

Have you seen a solicitor?
I know it is slightly different - but years ago i had a trailer stolen, 12 months later i "found" it (spotted it parked on someones premises) - they had bought it in good faith 3 weeks after it was stolen, and the police confirmed it was mine - but said i would have to go to court to get it back as it was a Civil Matter.
Anyhow - i spoke to my solicitor (lucky to have connections with a very good manchester solicitor) who sent the news "owners" a letter saying in "law" it was still my property so unless they returned it they would be charged the going rate of £X per day hire - i had it back within 24 hours! (thier solicitor confirmed to them that we were within our rights)
You are always told - The law says property always belongs to the original owner. - I would see a good solicitor (that you can trust!) - i am sure he should be yours to have back! |

| Unfortunatley i can not afford a solicitor, its costing £150 for civil court for original loanee, then we are going to scotland with the court order to have Tim returned again for another £150 fee. Its crazy!!!! Just wish it was all over and that Tim was home. |

I can't believe that the police are saying it is a civil case.....
I was sure that there was a change to the law regarding this, or am I dreaming it? It went along the lines that the fact that the person has taken the horse and is depriving the owner of owning it, means it is a criminal offense.....
I am just wondering where I got that information from 
I really hope this has a positive outcome for you and doesn't cost you a bomb. |

This sounds just dreadful for both you and Tim, still being apart. I had "trouble" with a livery contract last year and rang the British Horse Society Legal Advice line who were really helpful. Might be worth a phone call for a chat. Also, my insurance for Ryazan includes legal advice; perhaps yours does? Worth checking. I do hope it works out for you n Tim very soon.

The Micro Chip may help with this situation,in the future it contains the Horse/Ponies Unique Equine Life Number, but for this to be effective changes of ownership must be updated, and information lodged with The National Equine Data Base by the relevant Breed Society.

| Unfortunately this is almost the same everytime with the police, I had the same conclusion with my horse Charlie who was sold whilst out on loan the police have said its a civil matter and are not interested waiting to hear the outcome of 2 cases going through court them will persue mine. Good luck Lisa I will be thinking of you but sorry its too far to travel to be in court with you. |
