Hi - I am very close to buying an arab mare (just need her vet checked), but not having owned my own horse before I am a little confused about the difference between her "papers" and her "passport" - could anyone explain? Sorry if I am being a Numpty! Also her "papers" are still in the name of the woman who bred her, the current owner never bothered to change them as she knew the breeder very well, and the breeder told her it looks better if the horse does not appear to have had many owners - should I be worried? Her 'papers' probably refer to her registration document & her 'passport' is just that.
Obviously the breeder will need to have signed to confirm sale of the horse so when you get her you can register her in your name.
You shouldn't be worried, I think the current owner was just being honest with you.

Just make sure that you are given a transfer of ownership form, from the breeder to you. It cost £35 to have her changed into your name. A passport is NOT a proof of ownership, and should stay with the keeper of the horse at all times. I wouldn't be worried but make sure you are given the correct paperwork, before you part with your money. The wrong paperwork can cause all sorts of problems in the future. |

It may well be innocent but I would always check carefully if the papers do not appear to be in order. Ask for the breeders telephone number and discuss direct why the papers were not transferred. I know of too many situations where papers are said to be 'on their way' and it can be because there is a financial reason why they haven't been done properly and you don't want to be left picking up the tab !! Or ring the AHS, and enquire about the registration status. |

I would certainly check this up if it was me to buy the mare, as Emma said may well be innocent, but may also not be. The horse belongs to the person who is its registered owner, the person listed on its AHS registration certificate.(her papers) So unless there is a purchase contract, this person is not the legal owner of the mare. I would ask to see the purchase contract, and as said by others, you will need to get in touch with the breeder, she will need to sign the transfer of ownership form which needs to be sent to the AHS along with the registration certificate to be put in your name.
With all these bad loans etc going on at the moment, I feel its better to be sceptical when something is not right..

what has been said is correct, you need THREE pieces of paperwork to get your mare.
The passports duplicate the details from the registration certificate, eg all markings (which technically you should check agaisnt the horse you are buying!) which is stamped with the AHS imprint. this has a section for change of owner, and has to be sent to the AHS together with the piece paper that is notification of change of ownership.
The LAST registered owners signature needs to be on the transfer paper, and the last registered owner is on the registration certificate. these should match the passport.
Transfers are supposed to be recorded within a month, especially passports, but these time limits are often neglected and rarely create transfer problems if the signatures are there.
It is always worth a phone call to both breeder and Arab Horse Society to set your mind at rest. |

Thanks for all the really helpful advice. I have spoken to the breeder who has assured me that the horse is the current owners to sell, they just never got round to sending off the transfer of ownership form. The current owner showed me she still had the form dated by the breeder in 2005. I will call the AHS as soon as I can, to double check everything. The mare is being vet checked on Thursday so I really don't want any unecessary delays as I am VERY EXCITED !! |
