Judge orders return of donkeys and ponies By Andy Carswell ELEVEN donkeys and 18 Shetland ponies seized in an RSPCA search are to be returned to the farm they were taken from.
District Judge Sandeep Kainth today ruled at Oxford Magistrates Court the animals should be returned to Spindle farm, Chalk Lane, Hyde Heath after they were seized following an RSPCA investigation into allegations of animal cruelty.
The farm's owner, James Gray, had made a formal application to have the animals returned.
advertisement But the judge also ruled that around 80 horses that were removed from the farm at the same time should be sold. Currently the horses are in the care of the RSPCA at various rescue centres, but district Judge Kainth, said they must be sold at a market in Henley-in-Arden, Warwickshire, next month.
A vet who examined the horses in January told the court he was so concerned for their welfare he recommended they should be removed from the farm.
But he added the donkeys and ponies appeared to be in a "good condition."
Judge Kainth said: " These donkeys were never in any danger. They are to be returned forthwith."

James Gray, 44, Julie Gray, 40, Jodie Gray, 25, Cordelia Gray, 19, all of Spindle farm, Chalk Lane, pleaded not guilty to causing unnecessary suffering to protected animals between December 21 2007 and January 4 this year.
A teenager who can not be named for legal reasons also pleaded not guilty to the charges. After pleading not guilty to the charges they were granted unconditional bail. They are to re-appear at Oxford Magistrates court on April 28 for a pre-trial review.

OMG!!!!!!
I just can't believe that, poor things they will probably just end up in salami. I wonder if it includes that little donkey foal that was born that was pictured in all the national newspapers?!
As for selling the others at a market, why couldn't they stay with the rescue organisations? Who gets the money from the sale of them as well! The legal system in this country just really ***** me off. |

this is crazy...and they call it justice..it's a joke!
l feel sorry for the poor animals who go back..l would think the ones who are to be sold will get good homes as a lot of people will go to buy them, still would have been better to let the charity's home them..
anyone going?

That's is disgusting. All the people who donated to the rescue of these animals (including myself) will be so annoyed, that we have helped the animals only for them to end up in the feed chain. There is no justice and it is no wonder people take the law into their own hands. |

CRAP!!! Should have at least been banned from ever keeping any animals again. Whats the point of ever reporting anything to the authorities. Now this sort of thing will be rife because its just been broadcast that if you do it - you can get away with it. B****y judge wants starving - as long as we feed his kids - wont matter grrrrrrrr!!! |

It's just been on our local news, apparently the judge agreed to return some of the animals as they were pets and not considering likely to be subjected to any harm . Dear god, how absolutely depressing is this outcome, there really is no hope if such a high profile case as this results in such a crappy outcome. God I'm angry .

How bloody ridiculous. What exactly do these imbeciles have to do to an animal to be banned from keeping them. Maybe the judge took a 'back-hander'.

We are 10mins from Henley and I have posted this on 2 local forums that we have in the area. Im hoping someone will go and get 1 or 2. Most of them will probably end up at slaughter. As most the ponies that go to Henley are sold to slaughter.
Our Apache was at Henley when his previous owner saw him sold to a slaughter guy and payed a fortune to save him. I hope the word gets out and around! If loads of people turn up then theres a chance for them.
I don't know if my mom would take on another :( |

It beggers belief!
Just makes you wonder where the Judge is coming from. Either that or there were some very convinsing witnesses! I feel sorry for all the animals - just hope the ones going to the sale will be sold to good homes - doesnt bare thinking about :( |

Disgusting situation. What is puzzling me though is how this case was not deferred pending the outstanding trial. Surely if the case is not yet proved in law then this judgement is previous? |

is there no one we can write to?...an m p or something...surely this is not the outcome expected or wanted.... if this is the outcome for high profile cases why bother to even report them...nothing much is ever done..many people sent money or goods to help these horses it appears to have been a total waste of time.. yeah l am annoyed..and discusted..total fiasco!

I just CAN'T BELIEVE THIS!!!!!!!!!!!!!! Why has the judge ordered for the sale of the horses and who is going to end up with whatever amount they bring? I really am lost for words, who knows what these poor animals are going to go through next |
