First and big thanks you too all who replied to my last post it helped put my mind at rest that my horses are no different to the vast majority.
I did have a very good reason for the question I asked.
On 21st March, some people working for a company who shall have to remain nameless, entered my field without my knowledge or permission,to check a gas pipeline running underneath it, 20 minutes later we had a knock at the office door (we work from home) one of the the guys then said that they were just finishing the work when a pheasant spooked the horses who had 'gone ballistic', one had fallen and didn't look good, I ran out to see one of my mares laying dead on the field. I had checked the horss 10 minutes before these guys arrived, all 7 had been happily munching. Now, I don't know what spooked them, it certainly wasn't a pheasant,and also that the equipment being used was hazardous if it came into contact with electric fencing, which mine is, but whatever these guys had done the post mortem suggests that the mare would have been running in a blind panic, probably slipped and crashed to the ground causing massive internal injuries and bleeding, had she gone into one of the others they would also have been in a very bad way. These people have since said that ALL my horses completely ignored them when they went into the field and were all well away from them which I don't believe for one minute. What really makes this worse is that had they taken the trouble to ask, I would have been more than happy to bring the horses in, it would only have taken a few minutes.
PLEASE people, take note of who is on your land and watch them like hawks if you possibly can, the thought of this happening to anyone else worries the hell out of me.

ohhh you must be devastated....try taking this to a solicitor....you may be able to get compensation for the loss of your mare.

My thoughts are with you at this time.

Oh Rosie, OMG how absolutely awful for you. Your poor, poor horses. We have National Grid regularly check our fields as we have underground cables and one pylon at the far end. I shall watch them very carefully in future.

so very sorry to hear this. Hope you are going to see a solicitor. recently a firm changing electricity poles entered fields in my locality. ground churned up, gates opened etc.
I think this is a lesson to us all to put chains and locks on all gates, on the hinge side too, to stop anyone entering the field with a vehicle. cant do much about those on foot though.

thanks people. am going to solicitor next week, can't get an appointment any sooner, intend to hang them out to dry if poss, won't bring my poor mare back though.

rosyw, just want to add how sorry I am for your loss. This is so sad and unneccessary. I have re read your post and it is making me extreamly angry. I know these companies have a right to check thier pipes etc but they ought to be duty bound, legally, to let land owners know when they will visit, its outragous that they can spook animals like this. Perhaps we should write to our MPs and lobby for a law change so they HAVE to give people the chance to remove their stock.

What a terrible tragedy for you, I do hope all our answers help you get justice for the loss of your mare.

we rent the land, they had notified the landowner, very misleading info on exactly what they would be doing, and when, and as he has been through with combines etc. without causing the horses any worry or stress, he didn't think a couple of guys trailing a bit of thin wire would cause a problem, poor guy, he's as angry and upset as we are.

I had men in my field today and went out to ask who they were and what they were doing,one of our neighbours had got them out to check if he could run a waste water pipe into our septic tank,no one thought to ask us!!!

Furious, yes extremely, to make matters worse I have just been told that having said they would pay for post mortem (i think they were hoping she was about to drop dead anyway!) they are refusing to pay the transport costs to Newmarket and demanding proof of her value! How the hell do you do that!

I too am sorry to read this, and I would certainly contact a solicitor. Why do people just have no courtesy at all. I would write a letter of complaint to the Company and tell them that you seeking legal advice. They should NOT be allowed to get away with it.

I think we have a very good case, can't obviously go into too much detail.

Oh what a terrible shock for you. I can't begin to imagine what you are going through but I really hope that you get them to accept liability and pay for their actions. I know it won't bring back your mare but if it prevents this terrible thing happening to someone else then at least some good may come of it.

So, so sorry rosy, as I said in my email, it just makes me soooo angry. Surely it's not rocket science to realise that livestock may take fright when anything unusual happens. If it was children unintentionally scaring animals, they could be forgiven, but full grown men who should know better - it is just beyond belief.

Thanks again Carla, I'll get an email off to you when I'm back at my office desk in the morning, Just had to post this, as I said the thought of this ever happening again tears me apart, only thing that cheers me up is the looks on thier faces when my OH chased them down the drive being towed by a very angry Rotweiller!

I am so sorry to hear about this Rosie. I would be savagely angry too. Very best of luck with what you are now having to face, and making them realise the impact of what they have done. As someone else said, I know it won't bring your mare back, but it will make them think twice and stop the same thing happening again at their hands.
